Divorce in New Mexico: Preparing to divide marital assets

Community property and your marital estate

As New Mexico is a community property state, the value of any assets classified as part of the marital estate must be divided equally between spouses.

There are very few exceptions to this rule, although it is possible that an exception applies in your case.
