Egolf represents Ultra Health in lawsuit against NM Health Department

Attorney Brian Egolf filed a lawsuit against New Mexico Health Department on behalf of Ultra Health, the state’s largest producer and retailer of medical cannabis. The lawsuit questions the validity of the Health Department’s Medical Cannabis Program having the authority to license manufacturers of medical marijuana.

New Mexico’s medical marijuana laws require cannabis producers to be a nonprofit corporation and pay yearly fees up to $90,000. By stark contrast, the licensing fees for manufacturers are only $1000 annually. Additionally, the manufacturers have different regulation standards and are not subjected to frequent audits like the producers.

“The goal is to come up with a fair fee structure,” Egolf said.
